This summary is here to help. The full text below is what applies.
1. Who we are
This policy explains how Eclipse Publishing & Game Studios LLC (“Kettle Flame Games”, “we”, “us”) collects, uses, shares and protects personal information when you use kettleflamegames.com and its pages, forms and emails (together, the “Services”). We are a game studio based in the United States.
We are the “controller” (the business responsible) for the personal information described here. You can reach us about anything in this policy at support@kettleflamegames.com.
This policy covers our website and the services on it. Our games are sold and played through other platforms, such as Steam, which have their own privacy policies; if a game of ours collects data of its own, it will tell you in the game or on its store page.
2. What we collect
Information you give us
- Support requests. Your name, email, the topic, subject and message you send us, and our replies.
- Project inquiries. If you ask us to quote for work: your name, email, studio or game, engine, what you need, budget, timeline, any link you share and your description of the project.
- Job applications. The role, your name, email, location, experience, availability, portfolio and other links, why you want to join, anything else you choose to tell us, and our decision and any message we send you about it.
- Newsletter. Your email address and when you signed up.
- Anything else you send us, such as emails or Discord messages to the team.
Please don’t send us sensitive information (for example about health, religion, sexuality or government ID numbers) in a ticket, form or application. We don’t ask for it and don’t need it.
Information collected automatically
- Technical and log data. When you visit, our hosting platform receives your IP address, browser and device type, the pages you request, the referring page and the time. This is needed to deliver the site and keep it secure.
- Usage analytics. Our hosting platform records basic events such as page views, to tell us which pages are used. We use this in aggregate to improve the site, not to build profiles of individuals or for advertising.
- Browser storage. See Cookies and browser storage.
Information from others
If someone refers you for a job or a project, they may give us your name and contact details. We don’t buy personal information from data brokers.
3. How we use it, and our legal bases
We use personal information only for these purposes:
| Purpose | Legal basis (where the GDPR or UK GDPR applies) |
|---|---|
| Answering support requests and emails | Performing our contract with you; our legitimate interest in helping our players and visitors |
| Replying to project inquiries, quoting, and doing client work | Steps you asked for before entering a contract, and performing that contract |
| Considering job applications and contacting applicants | Steps you asked for before entering a contract; our legitimate interest in hiring |
| Sending the newsletter | Your consent, which you can withdraw any time by unsubscribing |
| Replying to you (answers to support requests, quotes, application decisions) | Performing our contract with you; our legitimate interest in keeping you informed |
| Understanding how the site is used and improving it | Our legitimate interest in running a useful website |
| Preventing spam, fraud and abuse, and enforcing our Terms | Our legitimate interest in protecting the Services and their users |
| Keeping records and meeting legal, tax and accounting duties, and handling legal claims | Legal obligation; our legitimate interest in defending our rights |
Where we rely on legitimate interests, we have weighed them against your rights, and you can object (see Your rights). We don’t use personal information for automated decisions that have legal or similarly significant effects on you.
6. How long we keep it
We keep personal information only as long as we need it:
- Support requests: up to three years after we close them, so we can follow up on the same problem, unless you ask us to delete them sooner.
- Accounts made before October 23, 2026: we no longer offer public accounts. If you made one before then, we keep it until you ask us to delete it, and we delete unused ones after three years.
- Project inquiries: up to three years after our last contact if no work goes ahead. If we work together, contract and invoice records are kept for seven years for tax and accounting.
- Job applications: up to two years after we make a decision, so we can consider you for future roles, unless you ask us to delete yours sooner. If we hire you, they become part of your personnel records.
- Newsletter: until you unsubscribe. Unsubscribing removes your address from our list straight away; our newsletter service may keep a record that you opted out so you aren’t emailed again.
- Logs and analytics: for as long as our hosting platform keeps them, typically up to 12 months.
Deleted data may remain in encrypted backups for a short period (usually up to 90 days) before it is overwritten. We may keep information longer where the law requires it or to deal with a legal claim.
7. Your rights
Wherever you live, you can ask us to:
- tell you what personal information we hold about you and how we use it, and give you a copy;
- give you that copy in a portable, machine-readable format;
- correct information that’s wrong or incomplete;
- delete your information;
- stop or limit how we use it, or object to our use based on legitimate interests;
- stop sending you the newsletter or any other marketing (every newsletter has an unsubscribe link).
How to do it. Send a request on our support page and choose “My data or privacy”, or email support@kettleflamegames.com. You can unsubscribe from the newsletter at /unsubscribe. We’ll reply within 30 days (45 days where US state law allows, and we’ll tell you if we need the extra time). It’s free.
We may need to confirm it’s really you, usually by asking you to reply from the email address on file. You can use an authorized agent; we’ll ask for proof that they act for you. If we can’t do what you ask, we’ll explain why, and you can appeal by replying to our decision; we’ll answer the appeal within 60 days. We will never treat you differently for using your rights.
Withdrawing consent. Where we rely on your consent (the newsletter), you can withdraw it at any time. That doesn’t affect what we did before.
8. Notice for US state residents
Residents of California and other US states with consumer privacy laws (including Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah and Virginia) have the rights in Your rights: to know and access, to correct, to delete, to data portability, and to opt out of the sale of personal information, sharing for cross-context behavioral advertising, targeted advertising and profiling. We don’t sell, share for advertising, target ads or profile, so there is nothing to opt out of.
In the last 12 months, we collected these categories of personal information, from the sources and for the purposes described above:
- Identifiers (name, email address, IP address)
- Customer records (contact details you give us in forms and tickets)
- Professional or employment information (in job applications and project inquiries)
- Internet activity (pages viewed and interactions with the site)
- Approximate location derived from your IP address
We disclosed these categories for business purposes only to the service providers listed in Who we share it with. We do not use or disclose sensitive personal information to infer characteristics about you. We have no actual knowledge of selling or sharing personal information of anyone under 16. California residents can also ask, once a year, about disclosures to third parties for their direct marketing; we make none.
9. If you're outside the United States
We are based in the United States, and our service providers may process data in the United States and other countries. Those countries may not have the same data protection laws as yours. When we transfer personal information out of the European Economic Area, the United Kingdom or Switzerland, we rely on the European Commission’s Standard Contractual Clauses (and the UK and Swiss equivalents) in our providers’ terms, or on the provider’s certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions. You can ask us for more information about these safeguards.
If you are in the EEA, the UK or Switzerland, you have the rights in Your rights under the GDPR or UK GDPR, and you can complain to your local data protection authority (in the UK, the Information Commissioner’s Office). We’d appreciate the chance to fix things first, so please contact us.
10. Keeping it safe
The site is served only over HTTPS. Each record in our database has access rules, so only the studio can see support requests, inquiries, applications and the newsletter list. Admin access is limited to the people who need it.
No system is perfectly secure, so we can’t guarantee security. If a breach affects your personal information, we’ll notify you and the authorities as the law requires, including under New York’s SHIELD Act.
11. Children
The Services aren’t directed to children under 13, and you must be at least 13 to sign up for the newsletter or contact us through a form. If you are under the age of digital consent where you live (up to 16 in some countries), you need a parent or guardian’s permission. Job applicants must be at least 18.
We don’t knowingly collect personal information from children under 13. If we learn we have, we’ll delete it. If you think a child has given us information, contact support@kettleflamegames.com.
12. Links and other sites
The Services link to sites we don’t control, including Steam, Discord, YouTube, X, Instagram and itch.io. Their privacy practices are their own, so read their policies. Our Discord server and social media accounts are governed by those platforms’ terms and policies; what you post there is visible to others on that platform.
13. Changes to this policy
We’ll update this policy when what we do changes, and change the effective date at the top. If a change is material, we’ll tell you before it takes effect, by email if we have your address or with a notice on the site, and where the law requires, we’ll ask for your consent. Earlier versions are available on request.
14. Contact us
